CPSC, Hazmat, and FDA Compliance for Indian Amazon Sellers

Three compliance gates block most Indian-origin products from selling on US Amazon: CPSC testing for kids items, Hazmat review for oils and cosmetics, FDA registration for food and supplements. Most Indian founders learn about these only after Amazon rejects their first FBA shipment. This guide covers what you need, when you need it, and the cost.

CPSC: mandatory for any product for kids under 12. $1,200-2,400 per SKU testing. Bureau Veritas Mumbai or Intertek Gurgaon.
Hazmat: Amazon reviews all oils, aerosols, and cosmetics. Send SDS/MSDS with first inventory. Free but adds 1-3 weeks.
FDA cosmetic registration: mandatory under MoCRA for any cosmetic. Free filing via FDA Cosmetic Direct portal.

CPSC for kids products

The Consumer Product Safety Improvement Act (CPSIA) requires every product intended for children 12 and under to undergo third-party testing at a CPSC-approved lab. This includes toys, children's clothing, kid-sized furniture, bedding, art supplies, and even children's textbooks.

Mandatory tests:

  • Lead content (in surface coatings and substrate)
  • Lead paint
  • Phthalates (in plastic/vinyl)
  • Small parts (choking hazard) - for under-3 products
  • Sharp points and edges
  • Tracking label compliance
  • ASTM F963 toy safety standard (toys only)
  • 16 CFR Part 1610 flammability (children's sleepwear and clothing)

After testing, you (the LLC) issue a Children's Product Certificate (CPC) - a one-page declaration of compliance that must accompany every shipment. Amazon will request CPC for any kids-category ASIN.

Cost per SKU: $1,200-2,400 depending on complexity. Wooden toys lean toward $1,200; multi-component STEM kits toward $2,400.

Timeline: 4-8 weeks at the lab. Plan for 10 weeks total including sample shipping.

Approved labs in India: Bureau Veritas (Mumbai, Gurgaon), Intertek (Gurgaon, Bangalore), SGS (Mumbai, Bangalore, Chennai), TÜV SÜD (Bangalore, Chennai).

Hazmat review

Amazon classifies any product containing flammable, pressurized, oxidizing, corrosive, or chemically-reactive material as "Hazmat." This is not about toxic ingredients per se - it's about transport safety. Hazmat-classified products may have:

  • Restricted FBA fulfillment centers (some FCs won't accept hazmat)
  • Higher fulfillment fees (typically +$0.40-1.20/unit)
  • Restricted shipping speeds (no air-shipped Prime in some cases)
  • Required tamper-evident packaging

For Indian-origin products, the categories that trigger Hazmat review most often:

  • Hair oils, body oils (anything >2 fl oz)
  • Aerosol sprays
  • Cosmetics containing alcohol-based ingredients
  • Cleaning products
  • Lithium-battery-containing electronics (toys, accessories)
  • Essential oils, perfumes

What you need: a Safety Data Sheet (SDS/MSDS) for each formulation. Your Indian manufacturer typically provides this, or you can have an Indian SDS-authoring service (~₹3,500-8,000 per formulation) create one.

Submit the SDS via Amazon's "Hazmat Review" process under your seller central. Review takes 1-3 weeks. Once your formulation is reviewed and approved, future shipments of the same SKU don't need re-review.

FDA cosmetic registration (MoCRA)

The Modernization of Cosmetics Regulation Act (MoCRA) took effect December 2023. It requires:

  1. Facility registration: every facility that manufactures or processes cosmetics for the US market must register with the FDA. This applies to your Indian manufacturer.
  2. Product listing: every cosmetic SKU sold in the US must be listed in the FDA Cosmetic Direct database. You list by ingredients.
  3. Responsible Person: every product must have a US-based "Responsible Person" - the entity legally accountable for the product's safety. Your US LLC qualifies as the Responsible Person.
  4. Safety substantiation file: internal documentation that you can produce ingredient safety data on request. Not filed with FDA, but required to exist and be available within 24 hours of FDA request.
  5. Adverse Event Reporting: if a consumer reports a serious adverse event (hospitalization, etc.), you must report it to FDA within 15 business days.

All four FDA filings are free. The cost is in the documentation work - getting your Indian manufacturer's facility registration paperwork in order, building the safety substantiation file, and writing FDA-compliant labels.

FDA food + supplements

For food products (spices, snacks, condiments) and dietary supplements (Ayurvedic herbs, capsules, powders):

  • FDA Food Facility Registration: required for any facility manufacturing food for the US market. Your Indian manufacturer must register. Free, biennial renewal.
  • Prior Notice: every food shipment to the US requires an FDA "Prior Notice" filing - submitted electronically before arrival. Free.
  • Dietary Supplement Disclaimer: "This statement has not been evaluated by the FDA. This product is not intended to diagnose, treat, cure, or prevent any disease." Required on label for any supplement making health claims.
  • Nutrition Facts panel: federal labeling standard. Must show serving size, calories, macronutrients, and key micronutrients in FDA-approved format.

Food is more compliance-heavy than cosmetics. For Indian Ayurvedic supplements specifically, also watch for: (a) heavy metal testing (lead, mercury, arsenic), (b) cGMP (current Good Manufacturing Practices) verification at your Indian facility, (c) no drug claims on label.

How to choose your lab

For Indian sellers, the four major CPSC-approved labs with strong India presence are Bureau Veritas, Intertek, SGS, and TÜV SÜD. Practical differences:

  • Bureau Veritas Mumbai: fastest turnaround in our experience (4-5 weeks). Strong on textiles and toys.
  • Intertek Gurgaon: deepest in cosmetics and food. Good for FDA-adjacent testing.
  • SGS Chennai: strongest in industrial and electronics. Less specialized in consumer goods.
  • TÜV SÜD Bangalore: best documentation quality. Slightly more expensive.
